Aussie Adventure Tours ("we," "our," or "us") reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website or services after any such changes constitutes your acceptance of the new Terms.

Definitions

Throughout these Terms, we use the following definitions:

• "Service(s)" refers to any tours, travel arrangements, accommodations, transportation, or other travel-related services provided by Aussie Adventure Tours.
• "Booking" refers to a reservation made for any of our Services.

• "User," "you," or "your" refers to any individual or entity using our Website or Services.
• "Traveler" refers to any individual participating in our tours or using our Services.

Booking and Payment

Booking Process

To make a booking, you must complete our booking form and provide all required information. A booking is not confirmed until we send you a written confirmation and receive your deposit or full payment, as applicable.

Accuracy of Information

You are responsible for providing accurate and complete information when making a booking. This includes but is not limited to names (as they appear on travel documents), contact details, special requirements, and travel preferences. Inaccurate information may result in additional fees, delays, or cancellation of services.

Prices and Payment

All prices are quoted in Australian Dollars (AUD) unless otherwise stated. We reserve the right to change prices due to factors beyond our control (such as currency fluctuations, government actions, or increases in supplier costs) before your booking is confirmed.

Payment terms:

• A non-refundable deposit of 25% of the total tour price is required at the time of booking.
• Full payment is due 60 days prior to the tour departure date.
• For bookings made within 60 days of departure, full payment is required at the time of booking.
• Payment can be made by credit card, bank transfer, or other methods specified on our website.

Fees and Surcharges

Additional fees may apply for:

• Credit card payments (1.5% for Visa/Mastercard, 2.5% for American Express)
• Late bookings (within 14 days of departure)
• Special requests or customizations
• Changes to bookings (see Cancellations and Changes section)

Cancellations and Changes

Cancellation by You

If you need to cancel your booking, you must notify us in writing. Cancellation fees apply as follows:

• More than 60 days before departure: Loss of deposit
• 59-30 days before departure: 50% of total tour price
• 29-15 days before departure: 75% of total tour price
• 14 days or less before departure: 100% of total tour price (no refund)

Changes by You

If you wish to make changes to your booking, we will make reasonable efforts to accommodate your request. Changes are subject to availability and the following fees:

• More than 60 days before departure: $50 per person per change
• 59-30 days before departure: $100 per person per change
• 29 days or less before departure: Changes treated as a cancellation and new booking

Cancellation or Changes by Us

We reserve the right to cancel or make changes to any tour or service for reasons including but not limited to insufficient participants, unforeseen circumstances, or events beyond our control. In such cases:

• We will offer you an alternative tour of equivalent or higher value at no additional cost, or a tour of lower value with a refund of the price difference.
• If no alternative tour is available or acceptable to you, we will provide a full refund of all payments made to us.
• We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

Travel Requirements and Responsibilities

Travel Documents

It is your responsibility to ensure that you have all necessary travel documents, including:

• Valid passport with at least six months validity beyond your return date
• Visas for all countries on your itinerary
• Travel insurance (strongly recommended)
• Vaccinations and health certificates as required by the destinations

We are not responsible for any consequences resulting from your failure to obtain or carry the necessary documents.

Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, delays, medical expenses, emergency evacuation, and personal belongings. We reserve the right to require proof of travel insurance for certain tours or destinations.

Health and Fitness

Our tours may involve activities requiring a reasonable level of fitness, health, and mobility. It is your responsibility to:

• Ensure you are physically capable of participating in the tour activities
• Disclose any medical conditions, disabilities, or special requirements at the time of booking
• Bring any necessary medications and medical supplies
• Follow all health and safety guidelines provided by your tour guide

We reserve the right to refuse a booking or remove a traveler from a tour if their participation presents a risk to themselves or others.

Limitations of Liability

Disclaimer of Warranties

Our services are provided "as is" without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Aussie Adventure Tours shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use our website or services
• Any actions or services of third-party suppliers (including airlines, hotels, tour operators, transportation providers)
• Delays, changes, or cancellations due to events beyond our reasonable control
• Personal injury, illness, or death not directly attributed to our negligence
• Loss or damage to personal belongings
• Any information obtained from third-party websites

In any case, our total liability shall not exceed the amount paid by you for the specific tour or service in question.

Force Majeure

We are not liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, acts of terrorism, civil unrest, strikes, supplier failures, or severe weather conditions.

Intellectual Property

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Aussie Adventure Tours or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

User Conduct

Travel Behavior

We reserve the right to remove any traveler from a tour whose behavior is deemed inappropriate, disruptive, or in violation of these requirements, without any refund or compensation.

Dispute Resolution

Any dispute arising from these Terms or your use of our services shall be resolved as follows:

1. Informal Resolution: We encourage you to contact us directly to resolve any concerns.
2. Mediation: If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through mediation in Queensland, Australia.
3. Arbitration: If mediation is unsuccessful, the dispute shall be settled by binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Aussie Adventure Tours regarding your use of our website and services.
